Agreement to these terms
By accessing or using FishList, you agree to these Terms of Use and our Privacy Policy. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree, do not use the service.
Eligibility and accounts
You must comply with applicable laws and any minimum age requirements in your region. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.
You agree to provide accurate information and to update it as needed so the service can function and so other users can identify you appropriately where the product displays your username or profile.
User content and acceptable use
You retain rights to content you submit, but you grant us a license to host, process, display, and distribute that content as needed to operate FishList (including community features and backups).
You will not misuse the service: no unlawful, harassing, hateful, or deceptive activity; no attempts to compromise security; no scraping or automated access that harms performance or violates technical limits; and no uploading of malware or harmful content.
We may remove content or suspend accounts that violate these rules or that we reasonably believe pose risk to users or the platform.
Maps, third-party data, and outdoor risk
Maps and third-party datasets (such as government stocking or boundary data) are provided for convenience and may be incomplete or outdated. You are responsible for verifying regulations, licensing, access rights, and safety before fishing.
Outdoor activities carry inherent risk. FishList does not guarantee conditions on the water, ice safety, weather, or navigation accuracy.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, FishList and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service.
Our aggregate liability for any claim relating to the service is limited to the greater of amounts you paid us for the service in the twelve months before the claim (if any) or fifty Canadian dollars (CAD), except where prohibited by law.
Changes
We may update these terms from time to time. Continued use after changes become effective constitutes acceptance of the revised terms. Material changes will be communicated in a reasonable manner when practical (for example, a notice in the application or by email if we have your address).
